W okresie od dnia wejścia w życie niniejszego zarządzenia do 31 grudnia 2019 r. działania, określone w Programie, o którym mowa w § 1, w ramach współpracy Ministra Środowiska z organizacjami pozarządowymi oraz podmiotami wymienionymi w art. 3 ust. 3 ustawy z dnia 24 kwietnia 2003 r. o działalności pożytku publicznego i o wolontariacie, realizuje się w Ministerstwie Środowiska odpowiednio, z wyłączeniem obowiązku oceny realizacji Programu.§ 3. Zarządzenie wchodzi w życie z dniem następującym po dniu ogłoszenia.MINISTER ŚRODOWISKAuzasadnieniePrzygotowanie i przyjęcie programu współpracy z organizacjami pozarządowymi i innymi podmiotami wymienionymi w ustawie z dnia 24 kwietnia 2003 r. o działalności pożytku publicznego i o wolontariacie (Dz. U. z 2019 r. poz. 668), tj. związkami wyznaniowymi, stowarzyszeniami, jednostkami samorządu terytorialnego, spółdzielniami socjalnymi, klubami sportowymi i spółkami nie działającymi w celu osiągnięcia zysku, jest – na podstawie art. 5b przywołanej ustawy – obowiązkiem każdego ministra. Ustawa dopuszcza przyjmowanie programów rocznych lub wieloletnich, z zastrzeżeniem że maksymalnie program może obejmować okres 5 lat. Zgodnie z ustawą program współpracy jest uchwalany do dnia 30 listopada roku poprzedzającego okres obowiązywania programu.Realizując zatem zobowiązania ustawowe Minister Środowiska przyjmuje Wieloletni program współpracy z organizacjami pozarządowymi oraz podmiotami wymienionymi w art. 3 ust. 3 ustawy o działalności pożytku publicznego i o wolontariacie na lata 2020-2024. Z uwagi na decyzję co do przyjęcia Programu o ogólnym charakterze odstąpiono od wyznaczania priorytetowych zadań publicznych oraz opisu trybu powoływania i zasad działania komisji konkursowych do opiniowania ofert w otwartych konkursach ofert (art. 5a ust. 4 pkt 5 i 11 ustawy o działalności pożytku publicznego i o wolontariacie). Realizacja zadań priorytetowych, mieszczących się w sferze zadań publicznych (art. 4 ust. 1 ustawy), została zawarta w Programie poprzez dopuszczenie możliwości zlecania organizacjom pozarządowym przedsięwzięć do realizacji zgodnie z przepisami ustawy, w tym zawartymi w art. 13-15 regulacjami dotyczącymi ogłoszenia otwartego konkursu ofert oraz powoływania komisji konkursowych do opiniowania ofert w otwartych konkursach ofert.
